# Restart Terms of Service

> The agreement between you and Restart: eligibility, acceptable use, ownership of what you build, AI-generated output, billing, liability, and the law that governs it.

Last updated September 23, 2026.

Welcome to Restart (“Restart”, “we”, “our”, or “us”). These Terms of Service (“Terms”) govern your access to and use of our website, restart.new (and the older skarmy.ai addresses that redirect here), and the Restart product at app.restart.new (together, the “Service”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please refrain from using the Service.

## 1. Eligibility and acceptance

You must be at least 13 years of age to use the Service. If you are between 13 and 18, you may only use the Service under the supervision and with the consent of a parent or guardian. By using the Service, you represent that you meet these requirements. Continued use after updates to these Terms constitutes acceptance of the revised Terms.

## 2. What Restart is

Restart is the AI company builder: you describe an idea, and Restart builds it into a working web product you can publish to a real URL and change by asking. The Service is that product and these websites — not the businesses built with it, which belong to the people who build them.

## 3. Your account

You need an account to build. Keep its credentials to yourself, tell us if you believe it has been compromised, and treat what happens under it as yours — because it is.

## 4. Use of the Service

You agree not to misuse the Service. That includes attempting to access data without authorization, interfering with the Service’s security or operation, probing or overloading it, and using automated scripts to collect information from it. Don’t use Restart to build anything illegal, infringing, or deceptive, and don’t send spam or malware from what you build. You are responsible for any content or communications you submit through the Service. Accounts that break these rules can be suspended or terminated.

## 5. What you build and your content

You retain ownership of everything you create on Restart — the companies, their pages, their words — and of any other content you submit. By submitting or publishing content, you grant Restart a worldwide, non-exclusive, royalty-free license to host, process, reproduce, and display it for the purpose of operating and improving the Service. The companies you launch are your businesses: what they sell, what they promise, and what they must comply with is on you.

## 6. AI-generated output

Restart’s builds are generated by AI. They can be wrong, incomplete, or resemble what was generated for someone else. Review what Restart builds before you publish or rely on it. The Service is not a substitute for a lawyer, accountant, or other professional: nothing Restart produces is legal, financial, tax, or investment advice, and Restart does not guarantee that any business built on it will succeed.

## 7. Third-party services

The Service relies on and may integrate with third-party platforms — payment processors, hosting and domain providers, and the AI model providers that do the building. Your use of those platforms is subject to their own terms and policies. We are not responsible for any third-party content, performance, or outages.

## 8. Fees, payments, and refunds

There is a free plan with daily build credits. Some features require payment. By submitting a payment method, you authorize us and our payment processors to charge the applicable fees. Subscription plans renew automatically unless canceled before the next billing period, and you are responsible for all applicable taxes. Unless expressly stated otherwise in writing, all purchases, fees, and charges are final and non-refundable: canceling a subscription prevents future renewals and keeps your access through the end of the period you have paid for, but does not entitle you to a refund for the current term. If a free trial is offered, you must cancel before it ends to avoid charges. We may, at our sole discretion, issue a one-time refund or credit in limited cases such as duplicate charges or verified billing errors; doing so does not create an obligation to do so again. The [Refund Policy](https://restart.new/refund) says the rest.

## 9. Communications consent

By providing your email address or phone number, you consent to receive messages from us, including build and account updates, security notices, and promotional content. You may opt out of non-essential messages at any time. Standard message and data rates may apply.

## 10. Privacy and data use

Your use of the Service is also governed by our [Privacy Policy](https://restart.new/privacy), which explains how we collect, use, and protect your information. By using the Service, you consent to those practices.

## 11. Restart’s property

The Service itself — its software, design, and branding — belongs to Restart. Feedback you send may be used to improve the Service without obligation to you.

## 12. Termination and data retention

You can stop using Restart and delete your account at any time. We may suspend or terminate your access to the Service at any time, with or without notice, and discontinue features with reasonable notice. Upon termination, your right to use the Service ceases immediately. We may retain certain information as required by law or for legitimate business purposes such as fraud prevention or dispute resolution. Sections that by their nature should outlive the account — ownership, disclaimers, liability, indemnification — do.

## 13. Disclaimer of warranties

The Service is provided on an “as is” and “as available” basis, without warranties of any kind. We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free.

## 14. Limitation of liability

To the maximum extent permitted by law, Restart and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of or inability to use the Service. Restart’s total liability for any claim is capped at what you paid Restart in the twelve months before the claim arose.

## 15. Indemnification

You agree to indemnify and hold harmless Restart and its affiliates from any claims, losses, or damages arising from what you build and publish, from your violation of these Terms, or from your misuse of the Service.

## 16. Governing law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. You agree to the exclusive jurisdiction of the state and federal courts located in San Francisco County, California, for any dispute arising from these Terms.

## 17. Severability and entire agreement

If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force and effect. These Terms, together with the Privacy Policy and Refund Policy, constitute the entire agreement between you and Restart regarding your use of the Service and supersede any prior agreements.

## 18. Changes to these Terms

We may modify these Terms at any time. Updates are posted on this page with the “Last updated” date revised accordingly, with reasonable notice for material changes. Your continued use of the Service after changes take effect indicates your acceptance.
